Industry insiders have analyzed what the latest live broadcast held by NewJeans signaled for the future of the HYBE vs. Min Hee Jin dispute.
On September 11 KST, NewJeans demanded that HYBE restore Min Hee Jin to her position as CEO of ADOR by September 25. Why did the members designate exactly 2 weeks, or 14 days?
According to legal experts, the move demonstrates the NewJeans members' intentions to file for the termination of their exclusive contracts. In order to legally proceed with a contract termination lawsuit, the artists must first submit a complaint against their current company, giving the company a 2-week period to respond to or address the artists' complaint. If the company chooses not to address the complaint, or fails to do so to the expectations of the artists, then the artists obtain the right to file an injunction request with the court (a legal request asking the court to recognize the invalidity of the exclusive contract), or move straight to the contract termination lawsuit.
Notably, Legal experts believe that NewJeans could not have made this decision and proceeded with the steps without help from a legal source, such as a legal team hired by their parents or by Min Hee Jin.
Meanwhile, it's predicted that HYBE Labels will not accept the terms set by NewJeans - to restore Min Hee Jin to her position as CEO of ADOR - meaning that a contract termination lawsuit may be inevitable in the near future.
In the case that this issue develops into a contract termination lawsuit, industry insiders will also be paying close attention to whether or not Min Hee Jin's possible interference in the decisions of the NewJeans members qualifies as "poaching", much like the case of the girl group FIFTY FIFTY.
