Defamation complaint filed by Kim Se Eui against Kim Soo Hyun fan union dismissed without charges

A defamation complaint filed by Kim Se Eui against the fan union of actor Kim Soo Hyun has been dismissed without charges.

Recently, the Kim Soo Hyun Fan Union revealed an official investigation result notice issued by the Gangnam Police Station in Seoul, confirming that the defamation complaint filed by YouTube channel Garo Sero Research Institute (Hoverlab) was concluded as “no suspicion” and therefore not forwarded for prosecution.

The case stems from May of last year, when the fan union held a truck protest in front of a press conference venue organized by Garo Sero Research Institute. At the time, messages displayed on the protest truck questioned claims made by Garo Sero Research Institute and the bereaved family of actress Kim Sae Ron.

In response, Garo Sero Research Institute filed a complaint against the fan union, alleging that statements claiming the channel had refused forensic analysis of Kim Sae Ron’s mobile phone, laptop, and tablet, as well as accusations that the channel was engaging in intimidation and stalking-style public opinion manipulation against Kim Soo Hyun, constituted false information amounting to defamation.

However, police determined that the statements did not meet the threshold of falsehood or illegality required for criminal punishment under defamation laws, leading to the decision not to pursue the case further.

In a statement, the fan union emphasized, “This decision marks the first instance in which investigative authorities have issued a judgment regarding derivative issues surrounding the Kim Soo Hyun case. It holds significance as the first official confirmation that the issues raised by Kim Soo Hyun and his fan union cannot be conclusively deemed criminally punishable falsehoods.”

The fan union added, “We will calmly observe as all facts are clearly established through investigative and judicial procedures, and we will continue to trust and wait for Kim Soo Hyun to prove the truth through lawful means and due process,” reaffirming their support for the actor.
