Lawyers speak out on Park Na Rae case, citing workplace harassment claims and mounting legal pressure

Lawyers are weighing in as comedian Park Na Rae’s ongoing dispute with her former managers continues to escalate.

As the conflict develops, legal experts appearing on television and YouTube have analyzed the situation from a legal perspective and urged caution. On January 16 KST, attorney Kang Eun Ha appeared on the YTN program ‘Lee Won Hwa Lawyer’s Case X File,’ stating, “This matter has gone beyond a simple entertainment industry dispute and is now multilayered, involving tax law, the Labor Standards Act, and even medical law.”

Regarding Park Na Rae’s past tax issues, attorney Kang explained that “the key issue is whether salaries were paid to family members or acquaintances who did not actually work,” adding that such cases are closely scrutinized by tax authorities and can lead to serious consequences.

She also addressed claims by former managers that they witnessed a ‘specific act inside a vehicle,’ emphasizing that “workplace harassment is not limited to the physical space of an office.” 

She explained, “There are precedents in which business trips, company dinners, and vehicles used during travel are recognized as workspaces if they are significantly related to work,” adding that “if it involves repeated and forced exposure in a situation where one cannot escape due to the use of a superior position, there is room for it to be judged as harassment.”

Attorney Kang further warned against engaging in what she described as ‘public opinion warfare.’ She cautioned, “Releasing emotional recordings or making statements on SNS may seem advantageous in public opinion, but they can actually work against you as circumstantial evidence in court or before the labor office,” stressing that both sides should respond based on objective evidence rather than emotion.

Meanwhile, another lawyer raised concerns about the possibility of Park Na Rae receiving an actual prison sentence. In the video below uploaded to the YouTube channel 'Jang Lawyer,' attorney Jang Hyun Oh discussed various allegations surrounding Park Na Rae, including illegal medical practices involving the so called ‘injection aunt.’

Attorney Jang explained that punishment depends on the degree of involvement, stating, “If the manager only relayed the schedule, there is no connection. But if messages like ‘What medication should you bring when you come today’ appear, then they are punished together.” He added that while some charges may individually result in fines, “they add everything together and decide what sentence fits this person. It is seen as concurrent offenses,” warning that “she could really end up going to prison.”

As legal opinions continue to emerge, attention remains focused on how authorities will assess the overlapping claims and what outcome Park Na Rae may ultimately face.
